1. Purpose
These terms of use (the “Terms”) govern access to and use of the noyzee.io website (the “Site”), which presents Brice Le Ficher and its editorial publications.
The Site is an information service. It does not provide access to the Noyzee platform, whose use is governed by a separate contract with each client.
Browsing the Site constitutes acceptance of these Terms. If you do not accept them, you should not use the Site.
2. Publisher
The Site is published by Brice Le Ficher, whose registered office is at 29 rue du Capitaine Ferber, 92130 Issy-les-Moulineaux, France. Full legal information appears in the legal notice.
3. Access to the Site
The Site is freely accessible, with no account required. Connection and equipment costs remain your responsibility.
The publisher endeavours to keep the Site available but gives no undertaking as to results. Access may be interrupted, in particular for maintenance, updates or force majeure, without giving rise to compensation.
4. Use of the Site
You undertake not to:
- impair the operation of the Site, in particular through abnormal load, intrusion attempts or the introduction of malicious code;
- carry out systematic or large-scale extraction of content, including by automated means, without written authorisation;
- use the content for purposes contrary to law, public policy or the rights of third parties.
5. Intellectual property
All elements of the Site: texts, analysis, described methodologies, graphic charters, the Noyzee trademark and logo, are protected by intellectual property law and remain the exclusive property of the publisher or its rights holders.
No licence is granted. Reproduction or representation, in whole or in part, on any medium, is prohibited without prior written authorisation. Quoting short extracts from an article is however permitted, provided “Noyzee” is clearly credited as the source and a link to the original page is included.
6. Status of editorial content
Articles published on the Site present market analysis for information purposes. The figures cited come either from public sources or from orders of magnitude illustrative of Noyzee’s work, and are provided by way of illustration. They constitute neither investment advice, nor a guarantee of results, nor a contractual undertaking, and cannot replace a tailored analysis.
7. Liability
The publisher takes the greatest care over the accuracy of the information published but does not warrant that it is exhaustive, error-free or up to date at all times. It cannot be held liable for decisions taken on that basis alone.
The Site may link to third-party sites over which the publisher exercises no control and for whose content it assumes no responsibility.
Nothing in these Terms limits the publisher’s liability in the event of gross negligence or wilful misconduct, or in any case where the law prohibits such limitation.
8. Personal data and cookies
The processing of personal data is described in the privacy policy and the use of trackers in the cookie policy.
9. Changes to the Terms
The publisher may amend these Terms at any time to reflect changes to the Site or to regulations. The applicable version is the one online at the time of your visit; the date of the last update appears at the top of this page.
10. Governing law and jurisdiction
These Terms are governed by French law. Failing an amicable resolution, any dispute relating to their interpretation or performance falls within the jurisdiction of the French courts, subject to the mandatory rules of jurisdiction applicable to consumers, who may bring proceedings before the courts of their place of residence.
